Update on Mount Saint Mary's Litigation

Brentwood Homeowners Association (BHA) is pleased to announce that it has reached a settlement agreement with Mount Saint Mary’s University (MSMU) and has subsequently dismissed its lawsuit. This agreement marks a significant milestone in the relationship between MSMU and the community, ensuring that MSMU can continue to deliver an outstanding education on its Chalon Campus while implementing measures to mitigate the impact of the University’s Wellness Pavilion and campus operations on the community. 

 

Historically, MSMU has operated without limitations on enrollment, traffic, and construction, differentiating it from other schools in the area.  This 20-year agreement marks a new beginning for the University and the community by implementing measurable limitations and providing transparency of MSMU’s operations.

 

The agreement includes conditions that were not mandated by the City approval, such as:

  • A reduction in average daily weekday vehicle trip caps from 2,160 to 1,813
  • Addition of vehicle trip caps for weekend (900) and summer (750)
  • Enrollment capped at 2,084
  • Prohibition of smoking on entire Chalon Campus
  • Community meetings held quarterly during construction and semiannually thereafter
  • Compliance with the vehicle trip caps through an electronic system that counts the ingress/egress of all vehicles 24/7; data provided to BHA four times a year to show compliance
  • Monetary damages for violations of the average vehicle trip caps and enrollment cap
  • Parking stickers and license plate registration for all students, faculty, and staff who utilize MSMU’s on-campus parking; enforcement of no parking on nearby streets
  • Bus size limited to 36 passengers
  • Ongoing education of all students and parents of students on emergency protocols
  • Inclusion of details regarding the Wildfire Emergency Plan in all parking and ticketing reservations for guests
  • Annual drill by the University to simulate execution of its Wildfire Emergency Plan, with an after report disseminated to LAFD, BHA and the Council Office
  • Incorporation of the City’s restrictions and conditions; any audits by or reports given to the City provided to BHA; private enforcement of City’s conditions.

BHA firmly believes the settlement agreement offers the best protection for our community over the next two decades and looks forward to working on behalf of the community with MSMU.
